Terms and Conditions for Climakosh

1. Introduction
These Terms and Conditions ("Terms") govern your access to and use of the Climakosh service ("Service") provided by MP Ensystems Pvt Ltd ("we," "our," or "us"). By accessing or using our Service, you agree to be bound by these Terms.

2. Description of Service
Our Service is a web-based application called Climakosh that is designed to provide updated accurate data, charts, reports and analysis on power, mobility, sustainability and other related sectors in India.

3. User Accounts
3.1. You must create an account to use our Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.2. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

4. Use of the Service
4.1. You agree to use the Service only for lawful purposes and in accordance with these Terms.
4.2. You shall not:
a) Use the Service in any way that violates any applicable federal, state, local, or international law or regulation.
b) Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service or any server, computer, or database connected to the Service.
c) Use the Service in any manner that could disable, overburden, damage, or impair the site or interfere with any other party's use of the Service.

5. Data and analysis
5.1. While we strive to provide accurate and useful output, we do not guarantee the accuracy, completeness, or usefulness of the data, analysis and other content provided by our Service. We do not provide investment advice and the data and analysis provided should be used as a starting point for further investigation and due diligence.
5.2 You agree to indemnify, defend, and hold harmless MP Ensystems Pvt Ltd and its officers, directors, employees, agents, and affiliates from and against any claims, disputes, demands, liabilities, damages, losses, and costs and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected your use of the Services or your violation of these Terms.

6. Intellectual Property Rights
6.1. The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by MP Ensystems Pvt Ltd, its licensors, or other providers of such material and are protected by Indian and international copyright, trademark, patent, trade secret, and other
intellectual property or proprietary rights laws.
6.2. These Terms permit you to use the Service for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service.

7. Payment Terms
7.1. We offer various subscription plans for our Service. By selecting a subscription plan and providing payment information, you agree to pay the fees associated with that plan.
7.2. All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties.
7.3. Subscription fees are non-refundable except as required by law or as explicitly stated in these Terms.

8. Termination
8.1. We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
8.2. You may terminate your account at any time by contacting us and requesting account deletion. Upon termination, your right to use the Service will immediately cease.

9. Limitation of Liability
9.1. In no event shall MP Ensystems Pvt Ltd, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

10. Disclaimer
10.1. Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

11. Governing Law
11.1 These Terms shall be governed and construed in accordance with the laws of Mumbai, Maharashtra, India, without regard to its conflict of law provisions. Any disputes arising under or in connection with these terms and conditions shall be submitted to the exclusive jurisdiction of the Bombay High Court.

12. Changes to Terms
12.1 We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any significant changes to these Terms by posting the new Terms on this page.
